Terms of Use
These terms and conditions of use (the “Terms”) govern access to and use of the Website www.aguasdevalenciainternacional.com (the “Website”) which VALORIA 2015, S.L. (“VALORIA”) makes available to you as a user of the Website (“User”).
The Terms, together with the Privacy Policy and the Cookies Policy, set out the terms of use governing the Website.
Use of the Website implies the User’s full acceptance of the Terms and Conditions in force at the time the User accesses it. Therefore, if the User does not agree with any of the conditions set out herein, they must refrain from using this Website.
VALORIA reserves the right to amend these Terms and Conditions at any time without prior notice. Furthermore, VALORIA reserves the right to suspend, interrupt or cease operations on the Website at any time. Similarly, VALORIA reserves the right to take all legal action available to it to enforce the liabilities arising from the User’s breach of any of the provisions of these Terms and Conditions.
1. General information
In accordance with the provisions of Law 34/2002 of 11 July on Information Society Services and Electronic Commerce, Users are hereby informed that the Website is owned by VALORIA 2015, S.L., a company with its registered office at Calle Maria Rosa Molas, 6 (12004) Castellón de la Plana, Spain, with Tax Identification Number (NIF) B-12-946-745. VALORIA is registered in the Castellón Commercial Register, in Page Number CS-37482.
The User may establish direct and effective communication with VALORIA by writing to the address indicated, as well as to the email address: people@aguasdevalencia.com
This email address will not accept the receipt of excessive personal data, or data that is out of date or incompatible with the activities carried out by VALORIA. Please be advised that if the request for which you wish to establish contact with VALORIA does not meet these requirements, it will be automatically deleted.
2. Use and management of the Website
2.1. Through the Website, VALORIA will provide the User with information about its business activities, namely the services it offers and the projects in which it participates at national and international level.
2.2. Users must make responsible and lawful use of the Website and the content hosted on it. The User acknowledges that they are over eighteen (18) years of age and accepts that access to and use of the Website and/or the content included therein takes place freely and knowingly, under their sole responsibility.
Access to the Website does not imply any kind of guarantee regarding the Website and/or the content included therein, as it is for information purposes only; consequently, no guarantee is offered as to its suitability for the particular or specific purposes that Users may expect or assume. The information provided may vary in accordance with any modifications that VALORIA may deem appropriate.
VALORIA may establish limitations and/or additional conditions for the use and/or access to the Website, which must be observed by Users in all cases.
2.3. The User undertakes to comply with these Terms and Conditions, as well as to follow the guidelines and instructions contained on the Website, and to act at all times in accordance with the law, good customs, public policy requirements and good faith, exercising the utmost care and diligence. To this end, the User shall refrain from using the Website in any way that may prevent, hinder, damage or impair its normal functioning or infringe upon any rights of VALORIA, other Users or, in general, any third party. Should VALORIA deem it appropriate, or should it be required to do so by court or administrative order, VALORIA shall remove from any content that infringes applicable legislation and/or infringes the rights of third parties.
By way of example and without limitation, the User undertakes to:
- Not to introduce or disseminate on or from the Website any information or material that is defamatory, obscene, threatening, xenophobic, pornographic, in support of terrorism, incites violence or discrimination on grounds of race, sex, ideology or religion, or that in any way undermines public order, public order, fundamental rights, civil liberties, honour, privacy or image of third parties, and, in general, applicable legislation.
- Not to introduce, store or disseminate via the Website any computer program, data, virus, code, or any other instrument or device that is capable of causing damage to the Website, to any of the services, or to any of the equipment, systems or networks of VALORIA, of any User or, in general, of any third party, capable of causing any kind of disruption or preventing their normal operation.
- You must not obstruct third parties’ access to the Website.
- You must not engage in any spamming, advertising, promotional or commercial exploitation of the Website. Consequently, the content and the information obtained via the Website must not be used to send advertising, send messages for the purposes of direct sales or for any other commercial purpose, or to collect or store personal data.
- Not to destroy, alter, render useless or damage VALORIA’s data, information or electronic documents displayed or included on the Website.
- Not to introduce or disseminate via the Website any content that infringes intellectual or industrial property rights or the rights of third parties, nor, in general, any content which you do not, in accordance with the law, have the right to make available to third parties.
2.4. Links, such as hypertext, banners, buttons, directories and any other search tools, understood as the technology connecting two websites or two web pages (hereinafter the “Link”), may not be used by Users to establish a connection with the Website. Access to the Website must be via the URL and using the credentials assigned by VALORIA; unauthorised third parties are not permitted to access the Website.
2.5. The sole purpose of VALORIA placing third-party links on the Website is to facilitate Users’ access to information provided by third parties and does not imply that VALORIA promotes, endorses, guarantees or recommends such third-party websites. The links included on the Website are provided solely for information purposes, without any assessment or guarantee regarding their content, ownership, or the services or products offered through them. Furthermore, VALORIA accepts no liability regarding their suitability, accuracy or functionality.

3. IP rights
All content displayed on the Website, including but not limited to designs, photographs, texts, graphics, logos, trademarks or any other intangible assets protected by industrial and intellectual property law, is subject to the intellectual and industrial property rights held by VALORIA or, where applicable, for which it has the necessary authorisation for inclusion on the Website.
Under no circumstances shall the publication of such content on the Website be construed as granting any licence to Users or as constituting a waiver, transfer, total or partial assignment of such rights, nor does it confer any right to exploit such assets.

4. Exclusion of warranties and liability for the contents of the Website
4.1. VALORIA does not guarantee the availability and continuity of the Website’s operation or of the services or content offered on it, including regarding its updating, and is hereby exempt from any liability for damages of any kind that may arise from such circumstances.
VALORIA shall, provided that no circumstances arise that render this impossible or difficult to carry out, and as soon as it becomes aware of any errors, disconnections and/or failure to update the content, undertake all necessary steps to rectify the errors, restore communication and/or update the said content.
Furthermore, VALORIA does not guarantee either the technical reliability of the Website or access to its various pages and is likewise exempt from any liability for damages of any kind that may arise from this cause.
Furthermore, VALORIA accepts no liability for any errors or security breaches that may arise from the User’s use of an outdated or insecure browser, regarding any damage, errors or inaccuracies that may result from its malfunction.
VALORIA implements the controls it deems necessary to ensure the security of its infrastructure. However, VALORIA does not guarantee the absence of viruses or other elements on the Website introduced by third parties unrelated to VALORIA that may cause alterations to Users’ systems or to the electronic documents and files stored on their systems. Consequently, VALORIA shall in no event be liable for any damages of any kind that may arise from the presence of viruses or other elements that may cause alterations to Users’ systems, documents or files.
4.2. VALORIA checks the content of the websites to which it links at the time it establishes a link to them. VALORIA includes such links on the Website at that time in the good-faith belief that such content complies with applicable legislation. 5. Partial invalidity
The declaration of any of the clauses contained in these Terms and Conditions as null, invalid or ineffective shall not affect the validity or effectiveness of the remaining clauses, which shall continue to be binding between the parties. A waiver by either party of the right to enforce any of the conditions set out herein at any given time shall not constitute a general waiver of the enforcement of any other condition or conditions, nor shall it create an acquired right for the other party.
6. Governing law and jurisdiction
These Terms and Conditions shall be governed by Spanish law. Any dispute arising therefrom shall be subject to the jurisdiction of the competent courts and tribunals as established by the applicable legislation.
